Purpose and ownership
The purpose of this Legal Notice is to make available to you the information that the LSSI requires of every information society service provider, and to set out the general conditions governing access to, browsing of and use of this website.
The owner of the site and the party responsible for the services is the entity whose identifying details are shown above (company name, tax identification number (NIF), registered office, Commercial Registry entry details, travel agency registration and insolvency guarantee). For reasons of accuracy and currency, these identifiers are not reproduced in the body of this document: the information in the identifying panel always prevails and, where applicable, that set out in our Terms and Conditions.
Through this site, travel care acts as an online travel agency that, depending on the case, intervenes as an intermediary or retailer of individual services provided by third parties (accommodation, flights, activities) and as an organiser of package travel (theme-park packages, multi-day guided tours, events and other combinations of services). The specific conditions of each booking are detailed in the Terms and Conditions.
Conditions of use of the site
Access to the site is free of charge, except for the cost of connecting via the telecommunications network you use. The booking of travel services is governed by the Terms and Conditions applicable to each reservation.
You undertake to use the site and its contents diligently, lawfully and in accordance with the law, this Legal Notice, good faith and public order. In particular, you agree not to:
- Make false, speculative or fraudulent bookings, or impersonate third parties.
- Introduce or spread content or programs (viruses, malicious code) that could damage the systems, equipment or documents of travel care or of third parties.
- Attempt to gain unauthorised access to restricted areas, to other users' accounts or to the site's infrastructure, or alter or circumvent its security measures.
- Extract, reproduce or reuse the site's contents, prices or availability on a massive or automated basis (by means of scraping, bots or similar means).
- Use the site for purposes contrary to the law, harmful to the rights of third parties or liable to impair its operation.
To use certain services you will need to identify yourself through our passwordless sign-in system (your email address as your identity, with a single-use link or a temporary code, and optional two-step verification). You are responsible for maintaining control and confidentiality over your email account and for the activity carried out through your account. You must be of legal age and have sufficient legal capacity to enter into contracts.
travel care reserves the right to deny or withdraw access to the site, without prior notice, to anyone who breaches these conditions.
Intellectual and industrial property
All elements of the site — including, by way of example, the source code, design, navigation structure, texts, photographs, illustrations, logos, icons, the travel care brand and its colours and distinctive signs, as well as the databases and other content — are protected by intellectual and industrial property law and belong to travel care or to third parties who have authorised their use.
Access to the site does not grant you any ownership right or licence to exploit those elements beyond what is strictly necessary to use the site personally and in line with its intended purpose. The reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, of the content without the prior written authorisation of its owner is prohibited.
The trade marks, trade names or distinctive signs of third parties (for example, of suppliers, airlines, hotel chains or parks) that may appear on the site belong to their respective owners and are shown solely for information purposes or to identify the service, without this implying any affiliation, sponsorship or endorsement, unless expressly stated.
If you believe that any content on the site infringes intellectual or industrial property rights, please let us know at travel@travelcare.io so that we can take appropriate action.
Exclusions and limitation of liability
travel care works to ensure that the information published on the site is accurate, current and complete, and that the service is available on a continuous basis. However, within the limits permitted by law, we cannot fully guarantee:
- The permanent accuracy and currency of the content. Information on availability, prices and the characteristics of accommodation, flights, activities, tours and events comes largely from external suppliers and systems and may change or contain typographical errors. The binding information is that confirmed during the booking process and in your contract documentation.
- Uninterrupted availability of the site. Access may be affected by maintenance work, updates, technical incidents or causes beyond our control. We will endeavour to minimise their impact and to give notice where possible.
Consequently, travel care is not liable for any loss or damage arising from: the lack of accuracy or currency of the content for reasons not attributable to the agency; interruptions, viruses or technical faults of the site or of the communication networks; or improper use of the site by the user.
Third-party services and force majeure. Where travel care acts as a mere intermediary for services provided by third parties, its liability is consistent with that role and with applicable law. Nor shall we be liable for any breach originating in force majeure or in unavoidable and extraordinary circumstances beyond our control. The foregoing is without prejudice to the liability incumbent on us, as organiser or retailer of package travel, under Directive (EU) 2015/2302 and Royal Legislative Decree 1/2007 (TRLGDCU), and to the rights that consumer law grants to consumers on a non-waivable basis.
Links (inbound and outbound)
This site may contain links to third-party websites (for example, of suppliers, payment gateways, social networks or information resources) that we consider may be of interest to the user. Such links are provided for information purposes only.
travel care does not control and assumes no responsibility for the content, policies, products or services of the linked sites, nor for any data processing carried out on them. The existence of a link does not imply any relationship, recommendation, sponsorship or approval of such content. We recommend that you review the legal notices and privacy policies of any external site you visit.
As regards inbound links, any third party wishing to set up a link to this site must do so to the home page or to complete pages, without reproducing the content on its own site, without creating confusion as to ownership, and without associating the link with unlawful content or content harmful to the image of travel care. The agency may request the removal of any link that breaches these conditions.
Status as a travel agency and insolvency guarantee
travel care operates as a duly registered travel agency with the Generalitat de Catalunya (the Government of Catalonia), meeting the requirements demanded by the applicable tourism regulations for carrying out this activity.
As an organiser and, where applicable, retailer of package travel, travel care holds the insolvency guarantee required by Directive (EU) 2015/2302 and Royal Legislative Decree 1/2007 (TRLGDCU). This guarantee is intended to cover the refund of payments made and, where appropriate, the repatriation of travellers in the event of the agency's insolvency.
The specific details of the travel agency registration and the insolvency guarantee (insurer and policy reference) appear in the identifying panel shown above and in our Terms and Conditions. Remember that package travel is a booking that includes at least two different types of travel service and that, before confirming it, its specific conditions are shown to you and you must expressly accept them together with the standard information form.
Personal data protection
The processing of your personal data is governed by Regulation (EU) 2016/679 (the GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). In our Privacy Policy you will find detailed information about who the data controller is, what data we collect, for what purposes and on what legal bases, how long we keep it, with which recipients we may share it, and how to exercise your rights of access, rectification, erasure, objection, restriction and portability.
If you have any query relating to the protection of your data, you can write to us at travel@travelcare.io.
Applicable law and jurisdiction
This Legal Notice and the use of this site are governed by Spanish law. For the resolution of any dispute relating to the site or its services, the parties submit to the Courts and Tribunals of Badalona, unless the applicable regulations impose another jurisdiction.
This submission is without prejudice to the rights that consumer law grants to consumers and users, including the option to bring proceedings before the courts of their place of residence where the law so provides.
If you booked online as a consumer, you also have at your disposal the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr. In any event, you can direct your complaints directly to travel@travelcare.io, where we will try to resolve them amicably.
Amendments and force majeure
travel care reserves the right to amend, at any time and without prior notice, the presentation, configuration and content of the site, as well as the conditions set out in this Legal Notice, in order to adapt them to legislative, technical or business developments. The version in force will always be the one published on this page, with its date of last update; we recommend that you review it periodically.
Likewise, travel care may suspend, interrupt or cease providing the site's service when technical, maintenance or security reasons arise, while endeavouring to minimise any inconvenience.
The unavailability of the site or of the services will not be considered a breach where it is due to force majeure or to unavoidable and extraordinary circumstances beyond the agency's reasonable control. Amendments to this Legal Notice do not affect the conditions of bookings already confirmed, which are governed by the Terms and Conditions accepted at the time of booking.
